Rules Governing the Stockpiling of Agricultural Waste

This rule change is a result of a petition received from the Idaho Dairyman’s Association. The changes will make the rule consistent with the statutory revisions implemented by the 2016 Idaho Legislature. This rule negotiation will be conducted simultaneously with six (6) other negotiated rulemaking dockets related to the statutory revisions made by the 2016 Idaho State Legislature in Senate Bill 1260.

Rulemaking Discontinuation
The amendment made to this rule is a non-substantive change that can be made outside of regular rulemaking procedures. The APA allows this change to be made without following regular rulemaking because it does not alter the sense, meaning or effect of the rule. Statutory citations, references to other rules whose names or IDAPA designations have changed, address changes, etc. fall into this category of “non-substantive” changes.
